El presente artículo, permite evidenciar la configuración de subjetividades de algunos adolescentes a partir de la visibilización del dolor, en tanto son portadores de una historia que los ha afectado, ya que han sido protagonistas directos de situaciones de violencia en escenarios que reclaman justicia social, tanto para sus familias como para la comunidad donde se movilizan. Antonio Ungar (Bogota, 1974) has published two novels: Zanahorias voladoras (Alfaguara, 2004) and Las orejas del lobo (Ediciones B, 2006). This paper aims to analyze the two literary works, based on the relationship between abjection and revolt (Kristeva 2006 (1980), 1998 (1996)) presented in the novels. This relationship will make it possible to understand, to a great extent, the author’s esthetic proposal, as well as his position in the current Colombian literary field and his answer to the social conditions of (...) his time. The guiding premise of this chapter is that we, as teachers in higher education, must consider how the content and form of our teaching can foster inclusivity through a responsiveness to neurodiverse learning styles. A narrow pedagogical focus on lectures, textual engagement, and essay-writing threatens to exclude neurodivergent students whose ways of learning and making sense of the world may not be best supported through these traditional forms of pedagogy. As we discuss in this chapter, we, as engineering ethics educators, (...) designed and implemented a new engineering ethics exercise with which we aimed to promote inclusivity at the levels of form and content. At the content level, students were invited to critically engage with inclusivity-undermining ableist assumptions in technology development. This took shape, at the form level, through a hands-on ‘material tinkering’ workshop in which students collaboratively and creatively altered (or ‘hacked’) artifacts used in contexts of disability and healthcare, so as to operationalize values of inclusivity and accessibility. Our hunch was that this hands-on tinkering workshop would simultaneously encourage a meaningful way of engagement with these ethical issues and values, while also enacting a more inclusive learning environment by enriching the range of pedagogical activities and learning formats available to our students.As we aim to show in this chapter, we believe this hunch largely panned out – though there are clear areas for future improvement pertaining to the pilot exercise itself and the research we conducted on the exercise. We begin by offering a description of our tinkering exercise. We discuss the exercise’s source of inspiration (Sect. 16.2.1) and its implementation (Sect. 16.2.2), which is visually captured via photographic documentation. We then discuss (Sect. 16.3) how we utilized a triangulated research method to assess the pedagogical value of the exercise. The compact and, with \ M\, very massive object located at the center of the Milky Way is currently the very best candidate for a supermassive black hole in our immediate vicinity. The strongest evidence for this is provided by measurements of stellar orbits, variable X-ray emission, and strongly variable polarized near-infrared emission from the location of the radio source Sagittarius A* in the middle of the central stellar cluster. Simultaneous near-infrared and X-ray observations of SgrA* have revealed insights into (...) the emission mechanisms responsible for the powerful near-infrared and X-ray flares from within a few tens to one hundred Schwarzschild radii of such a putative SMBH. If SgrA* is indeed a SMBH it will, in projection onto the sky, have the largest event horizon and will certainly be the first and most important target for very long baseline interferometry observations currently being prepared by the event horizon telescope. These observations in combination with the infrared interferometry experiment GRAVITY at the very large telescope interferometer and other experiments across the electromagnetic spectrum might yield proof for the presence of a black hole at the center of the Milky Way. The large body of evidence continues to discriminate the identification of SgrA* as a SMBH from alternative possibilities. It is, however, unclear when the ever mounting evidence for SgrA* being associated with a SMBH will suffice as a convincing proof. Additional compelling evidence may come from future gravitational wave observatories. This manuscript reviews the observational facts, theoretical grounds and conceptual aspects for the case of SgrA* being a black hole. We treat theory and observations in the framework of the philosophical discussions about “realism and underdetermination”, as this line of arguments allows us to describe the situation in observational astrophysics with respect to supermassive black holes. Questions concerning the existence of supermassive black holes and in particular SgrA* are discussed using causation as an indispensable element. We show that the results of our investigation are convincingly mapped out by this combination of concepts. (shrink)

As attention to the pervasiveness and severity of environmental challenges grows, technical universities are responding to the need to include environmental topics in engineering curricula and to equip engineering students, without training in ethics, to understand and respond to the complex social and normative demands of these issues. But as compared to other areas of engineering ethics education, environmental ethics has received very little attention. This article aims to address this lack and raises the question: How should we teach environmental (...) ethics to engineering students? We argue that one key aspect such teaching should address is the tendency of engineers towards technical framing of (social) problems. Drawing then on engineering ethics pedagogy we propose that the competencies of moral sensitivity and critical thinking can be developed to help engineering students with problem (re)framing. We conclude with an example from our teaching that operationalizes these competencies. (shrink)

While 4E approaches to cognition are increasingly introduced in educational contexts, little has been said about how 4E commitments can inform pedagogy aimed at fostering ethical competencies. Here, we evaluate a 4E-inspired ethics exercise that we developed at a technical university to enliven the moral imagination of engineering students. Our students participated in an interactive tinkering workshop, during which they materially redesigned a healthcare artifact. The aim of the workshop was twofold. Firstly, we wanted students to experience how material choices (...) at the levels of design and functionality can enable morally significant reimaginings of the affordances commonly associated with existing artifacts. We term this type of reimagining world-directed moral imagination. Secondly, through the design process, we wanted students to robustly place themselves in the lived embodied perspectives of (potential) users of their selected artifacts. We term this person-directed moral imagination. While student testimonies about the exercise indicate that both their world-directed and person-directed moral imagination were enlivened, we note that the fostering of robust person-directed moral imagination proved challenging. Using 4E insights, we diagnose this challenge and ask how it might be overcome. To this end, we engage extensively with a recent 4E-informed critique of person-directed moral imagination, raised by Clavel Vázquez and Clavel-Vázquez (2023). They argue that person-directed moral imagination is profoundly limited, if not fundamentally misguided, particularly when exercised in contexts marked by emphatic embodied situated difference between the imaginer and the imagined. Building upon insights from both the 4E field and testimonies from critical disability studies, we argue that, while their critique is valuable, it ultimately goes too far. We conclude that a 4E approach can take on board recent 4E warnings regarding the limits of person-directed moral imagination while contributing positively to the development of moral imagination in engineering ethics education. The use of automation in cars is increasing. In future vehicles, drivers will no longer be in charge of the main driving task and may be allowed to perform a secondary task. However, they might be requested to regain control of the car if a hazardous situation occurs. Performing a secondary task might increase drivers' mental workload and consequently decrease the takeover performance if the workload level exceeds a certain threshold. Knowledge about the driver's mental state might hence be useful (...) for increasing safety in conditionally automated vehicles. Measuring drivers' workload continuously is essential to support the driver and hence limit the number of accidents in takeover situations. This goal can be achieved using machine learning techniques to evaluate and classify the drivers' workload in real-time. To evaluate the usefulness of physiological data as an indicator for workload in conditionally automated driving, three physiological signals from 90 subjects were collected during 25 min of automated driving in a fixed-base simulator. Half of the participants performed a verbal cognitive task to induce mental workload while the other half only had to monitor the environment of the car. Three classifiers, sensor fusion and levels of data segmentation were compared. Results show that the best model was able to successfully classify the condition of the driver with an accuracy of 95%. In some cases, the model benefited from sensors' fusion. Increasing the segmentation level increased the performance of the model for windows smaller than 4 min, but decreased for windows larger than 4 min. In conclusion, the study showed that a high level of drivers' mental workload can be accurately detected while driving in conditional automation based on 4-min recordings of respiration and skin conductance. The “attention economy” refers to the tech industry’s business model that treats human attention as a commodifiable resource. The libertarian critique of this model, dominant within tech and philosophical communities, claims that the persuasive technologies of the attention economy infringe on the individual user’s autonomy and therefore the proposed solutions focus on safeguarding personal freedom through expanding individual control. While this push back is important, current societal debates on the ethics of persuasive technologies are informed by a particular understanding of (...) attention, rarely posited explicitly yet assumed as the default. They share the same concept of attention, namely an individualistic and descriptive concept of attention that is a cognitive process, an expendable resource, something that one should control individually. We step away from a negative analysis in terms of external distractions and aim for positive answers, turning to Buddhist ethics to formulate a critique of persuasive technology from a genuinely ethical perspective. Buddhist ethics points at our attention’s inescapable ethical and ontological embeddedness. Attention as practice requires “the right effort” to distinguish desirable and undesirable states, the “right concentration” to stop the flow we are caught in, and the “right mindfulness” to fortify the ability to attend to the present situation and keep in mind a general sense of life’s direction. We offer input for further philosophical inquiry on attention as practice and attention ecology. We put forward comfort/effort and individualism/collectivism as two remaining central tensions in need of further research. (shrink)

In contrast to vertical gene transfer from parent to offspring, horizontal (or lateral) gene transfer moves genetic information between different species. Bacteria and archaea often adapt through horizontal gene transfer. Recent analyses indicate that eukaryotic genomes, too, have acquired numerous genes via horizontal transfer from prokaryotes and other lineages. Based on this we raise the hypothesis that horizontally acquired genes may have contributed more to adaptive evolution of eukaryotes than previously assumed. Current candidate sets of horizontally acquired eukaryotic genes may (...) just be the tip of an iceberg. We have recently shown that adaptation of the thermoacidophilic red algaGaldieria sulphurariato its hot, acid, toxic‐metal laden, volcanic environment was facilitated by the acquisition of numerous genes from extremophile bacteria and archaea. Although it is frequently asserted that Greek poleis routinely laid legal claim to marine fisheries or even territorial waters, making them subject to special taxes and regulation, these assertions have little or no foundation in the evidence. For Greek fishermen the sea was freely and openly accessible, a fact that reflects the limited regulatory reach of ancient poleis. By virtue of what do alarm calls and facial expressions carry natural information? The answer I defend in this paper is that they carry natural information by virtue of changing the probabilities of various states of affairs, relative to background data. The Probabilistic Difference Maker Theory of natural information that I introduce here is inspired by Dretske's [1981] seminal analysis of natural information, but parts ways with it by eschewing the requirements that information transmission must be nomically underwritten, mind-independent, and (...) knowledge-yielding. PDMT includes both a qualitative account of information transmission and a measure of natural information in keeping with the basic principles of Shannon's communication theory and Bayesian confirmation theory. It also includes a new account of the informational content of a signal, understood as the combination of the incremental and overall support that the signal provides for all states of affairs at the source. Modeling law search and retrieval as prediction problems has recently emerged as a predominant approach in law intelligence. Focusing on the law article retrieval task, we present a deep learning framework named LamBERTa, which is designed for civil-law codes, and specifically trained on the Italian civil code. To our knowledge, this is the first study proposing an advanced approach to law article prediction for the Italian legal system based on a BERT (Bidirectional Encoder Representations from Transformers) learning framework, which has (...) recently attracted increased attention among deep learning approaches, showing outstanding effectiveness in several natural language processing and learning tasks. We define LamBERTa models by fine-tuning an Italian pre-trained BERT on the Italian civil code or its portions, for law article retrieval as a classification task. One key aspect of our LamBERTa framework is that we conceived it to address an extreme classification scenario, which is characterized by a high number of classes, the few-shot learning problem, and the lack of test query benchmarks for Italian legal prediction tasks. To solve such issues, we define different methods for the unsupervised labeling of the law articles, which can in principle be applied to any law article code system. We provide insights into the explainability and interpretability of our LamBERTa models, and we present an extensive experimental analysis over query sets of different type, for single-label as well as multi-label evaluation tasks. Empirical evidence has shown the effectiveness of LamBERTa, and also its superiority against widely used deep-learning text classifiers and a few-shot learner conceived for an attribute-aware prediction task. The sense of agency is the experience of being the origin of a sensory consequence. This study investigates whether contextual beliefs modulate low-level sensorimotor processes which contribute to the emergence of the sense of agency. We looked at the influence of causal beliefs on ‘intentional binding’, a phenomenon which accompanies self-agency. Participants judged the onset-time of either an action or a sound which followed the action. They were induced to believe that the tone was either triggered by themselves or by (...) somebody else, although, in reality, the sound was always triggered by the participants. We found that intentional binding was stronger when participants believed that they triggered the tone, compared to when they believed that another person triggered the tone. These results suggest that high-level contextual information influences sensorimotor processes responsible for generating intentional binding. (shrink)

The aim of this article is to question the nature of the socio-anthropological approach in Lefort’s thought. The author explores the complex relationship between Lefort and the Durkheimian French school of sociology in four stages: in the first, he shows Lefort as a sociologist ‘worthy of its name’ or, in other words, a sociologist interested in questioning the ‘institution of the social’. In the second, he focuses on the disturbing elements that Lefort introduces: the political and the division into the (...) French sociological approach. In the third stage, he focuses his attention on the sociological approach in Lefort’s way of thinking about democratic society. Finally, he concludes by referring to Lefort’s apparent opposition between philosophy and social sciences – and the errors that this may have engendered – in order to demonstrate the continuity of Lefort’s sociological approach. Edmund Husserl is regarded as the founder of transcendental phenomenology, one of the major traditions to emerge in twentieth-century philosophy. In this book Andrea Staiti unearths and examines the deep theoretical links between Husserl's phenomenology and the philosophical debates of his time, showing how his thought developed in response to the conflicting demands of Neo-Kantianism and life-philosophy. This book offers a comprehensive account of vitalism and the Romantic philosophy of nature. The author explores the rise of biology as a unified science in Germany by reconstructing the history of the notion of “vital force,” starting from the mid-eighteenth through the early nineteenth century. Further, he argues that Romantic Naturphilosophie played a crucial role in the rise of biology in Germany, especially thanks to its treatment of teleology. In fact, both post-Kantian philosophers and naturalists were guided by teleological (...) principles in defining the object of biological research. The book begins by considering the problem of generation, focusing on the debate over the notion of “formative force.” Readers are invited to engage with the epistemological status of this formative force, i.e. the question of the principle behind organization. The second chapter provides a reconstruction of the physiology of vital forces as it was elaborated in the mid- to late-eighteenth century by the group of physicians and naturalists known as the “Göttingen School.” Readers are shown how these authors developed an understanding of the animal kingdom as a graded series of organisms with increasing functional complexity. Chapter three tracks the development of such framework in Romantic Naturphilosophie. The author introduces the reader to the problem of classification, showing how Romantic philosophers of nature regarded classification as articulated by a unified plan that connects all living forms with one another, relying on the idea of living nature as a universal organism. In the closing chapter, this analysis shows how the three instances of pre-biological discourse on living beings – theory of generation, physiology and natural history – converged to form the consolidated disciplinary matrix of a general biology. The book offers an insightful read for all scholars interested in classical German philosophy, especially those researching the philosophy of nature, as well as the history and philosophy of biology. Organoids are three-dimensional biological structures grown in vitro from different kinds of stem cells that self-organise mimicking real organs with organ-specific cell types. Recently, researchers have managed to produce human organoids which have structural and functional properties very similar to those of different organs, such as the retina, the intestines, the kidneys, the pancreas, the liver and the inner ear. Organoids are considered a great resource for biomedical research, as they allow for a detailed study of the development and pathologies (...) of human cells; they also make it possible to test new molecules on human tissue. Furthermore, organoids have helped research take a step forward in the field of personalised medicine and transplants. However, some ethical issues have arisen concerning the origin of the cells that are used to produce organoids and their properties. In particular, there are new, relevant and so-far overlooked ethical questions concerning cerebral organoids. Scientists have created so-called mini-brains as developed as a few-months-old fetus, albeit smaller and with many structural and functional differences. However, cerebral organoids exhibit neural connections and electrical activity, raising the question whether they are or will one day be somewhat sentient. In principle, this can be measured with some techniques that are already available, which are used for brain-injured non-communicating patients. If brain organoids were to show a glimpse of sensibility, an ethical discussion on their use in clinical research and practice would be necessary. (shrink)

Clarifying the nature of possibility is crucial for an evaluation of the phenomenological approach to ontology. From a phenomenological perspective, it is ontological possibility, and not spatiotemporal existence, that has pre-eminent ontological status. Since the sphere of phenomenological being and the sphere of experienceability turn out to be overlapping, this makes room for two perspectives. We can confer foundational priority to the acts of consciousness over possibilities, or to pre-set possibilities over the activity of consciousness. Husserl’s position on this issue (...) seems to change over time. Ultimately, the establishment of a phenomenological perspective must involve a rejection of any hypostatization of pre-set possibilities, but not all implications of this theoretical step seem to be drawn in Husserl’s texts. This paper is devoted to an illustration of how the phenomenological notion of possibility should change when we reject the hypostatization of possibility, that is, when we reject the idea that all acts of consciousness are to be conceived as realizations of pre-set “ideal forms”. We examine this question, first, by trying to clarify the conceptual constellation of “possibility” in Husserl’s texts. This leads to an overall classification of the features of constituted possibilities. Then we distinguish such constituted possibilities from their constituting conditions, which outlines a different sense of “possibility”. In the last instance two “possibilizing” dimensions are shown to lie at the root of all ontic possibilities. This leads to a final suggestion on the nature of the relation between experience and possibility. Actual experiences create the room for possibility: they are possibilizations. In this sense, experience is to be taken as a generative sphere which goes beyond the customary boundary between epistemic and ontological. I discuss an interpretation, recently proposed by Mark Siderits, of the claim that within the Buddhist tradition the self is a convenient fiction. I subsequently propose a novel approach to fictionalism in contemporary metaphysics, outline an application of such an approach to the case of the self and then specify one version of fictionalism combined with some basic tenets of Buddhism.

Previous research has shown that subliminally presented stimuli accelerate or delay responses afforded by supraliminally presented stimuli. Our experiments extend these findings by showing that unconscious stimuli even affect free choices between responses. Thus, actions that are phenomenally experienced as freely chosen are influenced without the actor becoming aware of the manipulation. However, the unconscious influence is limited to a response bias, as participants chose the primed response only in up to 60% of the trials. LRP data in free choice (...) trials indicate that the prime was not ineffective in trials in which participants chose the non-primed response as then it delayed performance of the incongruently primed response. Though widely derided by popular psychologists and self-help writers as an emotionally toxic and destructive response, blame has many defenders among contemporary moral philosophers. Blaming wrongdoers has been thought to express deep commitment to moral values and norms, to be intimately bound up with practices of holding others responsible, and to be an important exercise of moral agency. In this paper I push against the grain of such defenses of blame just enough to articulate what seems right in the more (...) popular lines of critique. I distinguish between blame as a reactive attitude and blaming as a speech act, and argue that some disagreement over the value of blame can be explained by the fact that blaming, as a speech act, takes several distinct forms. Critiques of blame, I suggest, properly target what we might call judgmental or strongly verdictive blaming, the sort of blaming that passes judgment on the wrongdoer him- or herself, and treats him or her as deserving of the blamer’s hostile or “punishing” reactions. This kind of blaming, I argue, tends to foreclose engagement in further moral dialogue with wrongdoers, an effect that is particularly destructive in therapeutic contexts. In such contexts, it is often more appropriate—and more constructive—to hold others answerable without blaming them in the strongly verdictive sense. I argue, moreover, that strongly verdictive blame may be similarly destructive outside of straightforwardly therapeutic contexts, and I challenge the idea that there is in any case a sharp or clear dividing line between therapeutic and non-therapeutic responses to wrongdoers. Holding answerable in a non-judgmental mode is a response that may have a therapeutic dimension, but it nonetheless engages a wrongdoer as a moral peer and partner in moral dialogue. This account of non-judgmental answerability, I suggest, captures much of what moral philosophers have taken to be valuable about blame, while accommodating the insights of those who criticize its more toxic forms. In ancient Greece, philosophers developed new and dazzling ideas about divinity, drawing on the deep well of poetry, myth, and religious practices even as they set out to construct new theological ideas. Andrea Nightingale argues that Plato shared in this culture and appropriates specific Greek religious discourses and practices to present his metaphysical philosophy. In particular, he uses the Greek conception of divine epiphany - a god appearing to humans - to claim that the Forms manifest their divinity epiphanically (...) to the philosopher, with the result that the human soul becomes divine by contemplating these Forms and the cosmos. Nightingale also offers a detailed discussion of the Eleusinian Mysteries and the Orphic Mysteries and shows how these mystery religions influenced Plato's thinking. Political theorists aiming to articulate normative standards for the EU have almost entirely focused on whether or not the EU suffers from a ‘democratic deficit'. Almost nothing has been written, by contrast, on one of the central values underpinning European integration since at least the European Coal and Steel Community (ECSC), namely solidarity. What kinds of principles, policies, and ideals should an affirmation of solidarity commit us to? Put another way: what norms of socioeconomic justice ought to apply to the (...) EU? This is not an empirical or narrowly legal question. We are not trying to gauge the degree of attachment there currently is in the EU by, for example, citing the latest Eurobarometer poll. We are also not attempting to state the implicit rationale followed by the Court of Justice in its recent ‘solidarity’ jurisprudence, let alone trying to fix what the Commission might mean by it. In this article, I ask the more fundamental question underlying both the legal and the empirical questions: What principles of social solidarity ought to apply between states and citizens of the emerging European polity? This question has rarely been asked or answered by political theorists in an EU context, so we are entering largely uncharted territory. The article develops a tripartite model of EU solidarity in Section 2, and then applies it to the case of free movement of persons in Section 3. (shrink)

Current debates on collective intentionality focus on the cognitive capacities, attitudes, and mental states that enable individuals to take part in joint actions. It is typically assumed that collective intentionality is a capacity which is added to other, pre-existing, capacities of an individual and is exercised in cooperative activities like carrying a table or painting a house together. We call this the additive account because it portrays collective intentionality as a capacity that an individual possesses in addition to her capacity (...) for individual intentionality. We offer an alternative view according to which the primary entity to which collective intentionality has to be ascribed is not the human individual, but a “form of life.” As a feature of a form of life, collective intentionality is something more than the specific capacity exercised by an individual when she cooperates with others. Collective intentionality transforms all the capacities of the bearers of this specific form of life. We thus call our proposal the transformative account of collective intentionality. (shrink)

The first question is the one of the relationship between the semantic analysis of modality and the structure of arguments. The second question is the one of the distinctive place, or role, of modality in the fundamental structure of arguments. These two questions concern how modality, as a semantic category, relates to the fundamental structure of arguments. The book addresses modality and (...) argumentation also according to another perspective by looking at how different linguistic modal expressions may be taken as argumentative indicators. It explores the role of modal expressions as argumentative indicators by using the Italian modal system as a case study. Our aim in this paper is to employ conceptual negotiation to inform a method of rethinking defective food concepts, that is concepts that fail to suitably represent a certain food-related domain or that offer representations that run counter to the interests of their users. We begin by sorting out four dimensions of a food concept: the data upon which it rests and the methodology by which those data are gathered; the ontology that sustains it; the social acts that serve to (...) negotiate and establish the concept; and the aims and values that it fosters. We then discuss the conditions that make a food concept defective, pointing out four types of defects—fragility, polarization, incoherence, and schizophrenia—which we illustrate by means of two specific examples: local food and healthy food. Autonomy, at least in one sense of the term, requires sovereign authority over one’s choices and actions. In this paper, I argue that such authority is relational in at least two respects. First, I argue that sovereign authority may be shared – and, indeed, must be shareable – with others through the exercise of normative powers. Second, I argue that normative powers are themselves relational powers, powers that depend in part on the recognition of agents as having an equal basic (...) authority to exercise such powers in the first place. Drawing on feminist speech-act analyses of silencing and subordination, I examine how failures of uptake for exercises of normative powers compromise personal autonomy. (shrink)

This essay attempts to interrogate the distinct character of Peter Sloterdijk’s declaration of the absolute imperative that concludes his work, You Must Change Your Life, by contextualizing it within the development of his notion of anthropotechnics. In particular, the essays examine the claim that his is a new and unprecedented form of the absolute imperative that is alone able to address, in an effective way, the contemporary global crises that are confronting us now. The first sections trace out the ways (...) in which this new imperative differs from previous forms of the imperative, including the categorical, the aesthetic, and the existential-ontological. The latter sections then discuss how the new form of the imperative is connected to Sloterdijk’s radical attempt at a rethinking of the essence of the human as always already technological, which is the very project of anthropotechnics. This leads finally to a discussion of Sloterdijk’s polemical engagement with Heidegger’s question concerning technology, in which I trace out his attempt at a sweeping translation of Heidegger’s notion of enframing [Gestell] into enhousing [Gehäuse] and the consequences thereof. In recent years, the decent work agenda has called upon vocational psychologists to advance psychological research and intervention to promote work as a human right. Furthermore, the COVID-19 pandemic is having disproportionate consequences on vulnerable workers, such as unemployment and underemployment, highlighting the need to enhance access to decent work for these workers. As a response, the present perspective article advances job crafting as a promising way to shape decent work for marginalized workers. To this end, the article deals with (...) decent work and job crafting, starting with the definition of decent work according to the psychology of working theory and examining the evolution of the construct of job crafting. Subsequently, the literature on job crafting is discussed, focusing on variables related to the PWT model of decent work and their effect on vulnerable workers. Finally, possibilities for further research and intervention aimed at promoting decent work through job crafting are discussed. (shrink)

Gestational surrogacy is ethically complex, generating very different responses in law and policy worldwide. This paper argues that contemporary surrogacy law and policy, across many jurisdictions, fail to give sufficient attention to the significance of the relationship between the child and the gestational surrogate. This failure risks repeating the mistakes of historical, discredited approaches to adoption and donor‐assisted conception. This paper argues that proper recognition of the significance of gestation must be an organising principle in surrogacy law and policy. The (...) paper begins by pointing to examples of surrogacy law and practice where the role of the gestator is unacceptably minimised, most notably the framing of the surrogate as a mere ‘carrier’. It goes on to examine the nature of gestation, including consideration of contemporary scholarship on the metaphysics of pregnancy and emerging work in epigenetics, and argues that current evidence supports the view that the gestational relationship must be taken more seriously than it currently is. The paper then draws analogies with parenthood in donor‐assisted conception and adoption to argue that approaches to parental status in novel family formations that fail to promote transparency and seek to deny the truth of familial relationships are doomed to fail. The paper concludes by suggesting some implications for law and policy that flow from placing sufficient emphasis on the gestational role. The overarching thesis of this paper is that gestational surrogacy is ethically permissible when these fundamental requirements are adhered to, and that surrogacy law should proceed on this basis. Phenomenology has been defined by Husserl as “theory of the essences of pure phenomena,” yet the ontological status of essences in Husserlian phenomenology is far from a settled issue. The late Husserlian emphasis on genetic constitution and the historicity of the lifeworld is not immediately reconcilablewith the ‘unchangeable’ nature that is prima facie attributed to essences. However, the problem of the nature of ideality cannot be dropped from phenomenological accounts without jeopardizing the phenomenological enterprise as such. Through an immanent analysis (...) of Husserl’s meditation on essences a positive account of their ontological status is provided. Essences are interpreted as ontological thresholds, primordially rooted in our motivated confrontation with sensuous transcendence. Essences appear as emergent ontological features, which are not reducible to their particular realizations and which exhibit a fundamental continuity between consciousness and being. They manifest themselves as prospectively a priori (a precondition for further experiences), but retrospectively a posteriori (they are founded in experience). Finally, essences manifest the ‘co-essential’ nature of consciousness and sensuous transcendence: they are the way in which we are motivated and constitutively bound to articulate being, which in turn is apt to be thus articulated. What distinguishes theology from the other uses of language? Is theology a specific language, or is it a specific situation of language, a specific way to consider language? I start with the issue of language’s inadequacy before divine revelation. By analyzing the variety of answers to this inopia verborum, I show that the theological inadequacy of language is not conceptual, but formal: it concerns the metalinguistic definition of inadequacy. Then, I formalize the relationship between metalanguage and object language, and I (...) argue that theology applies precisely to this formal relationship. From this, I deduce that the function of theology is to question the need for metalinguistic foundation and validation—given that this need characterizes human language, that is, what is not divine revelation. I end with two applications: on one hand, to the axiomatization of theology; on the other hand, to the methodology for inter-religious dialogue. (shrink)

This study assessed the attitudes and needs of physicians and health professional staff at a tertiary care hospital in Canada regarding the introduction of physician assisted dying (PAD) during 2015–16. This research aimed to develop an understanding of the wishes, concerns and hopes of stakeholders related to handling requests for PAD; to determine what supports/structures/resources health care professionals (HCP) require in order to ensure high quality and compassionate care for patients requesting PAD, and a supportive environment for all healthcare providers (...) across the moral spectrum. This study constituted a mixed methods design with a qualitative descriptive approach for the study’s qualitative component. A total of 303 HCPs working in a tertiary care hospital completed an online survey and 64 HCPs working in hospital units with high mortality rates participated in 8 focus group discussions. Both focus group and survey data coalesced around several themes to support the implementation of PAD following the decriminalization of this practice: the importance of high quality care; honoring moral diversity; supporting values (such as autonomy, privacy, beneficence); and developing resources, including collaboration with palliative care, education, policies and a specialized team. This study provided the foundational evidence to support the development of the PAD program described in other papers in this collection, and can be a model for gathering evidence from stakeholders to inform the implementation of PAD in any healthcare organization. Both Aristotle and Kant note that the highest form of friendship enables individuals of good virtue to reveal themselves to one another. I argue that Aristotle and Kant emphasize complementary aspects of self-disclosure in friendship: whereas Kant acknowledges the inherent value of self-disclosure in friendship, Aristotle suggests that joint perception in friendship is instrumentally valuable in the acquisition of self-knowledge. I also argue that although Aristotle has a more developed account of friendship, Kant advances a superior account of self-disclosure in (...) friendship in his later remarks on friendship in the Metaphysical Principles of Virtue. Several scholars have recognized the limitations of theories of moral reasoning in explaining moral behavior. They have argued that moral behavior may also be influenced by moral identity, or how central morality is to one’s sense of self. This idea has been supported by findings that people who exemplify moral behavior tend to place more importance on moral traits when defining their self-concepts (Colby & Damon, 1995). This paper takes the next step of examining individual variation in a construct highly (...) associated with immoral behavior — psychopathy. In Study 1, we test the hypothesis that individuals with a greater degree of psychopathic traits have a weaker moral identity. Within a large online sample, we found that individuals who scored higher on a measure of psychopathic traits were less likely to base their self-concepts on moral traits. In Study 2, we test whether this reduced sense of moral identity can be attributed to differences in moral judgment, which is another factor that could influence immoral behavior. Our results indicated that the reduced sense of moral identity among more psychopathic individuals was independent of variation in moral judgment. These results suggest that individuals with psychopathic traits may display immoral behavior partially because they do not construe their personal identities in moral terms. (shrink)

Assume consequentialism and assume moral properties are causally efficacious. Then, I’ll argue, a puzzle arises. These assumptions lead to denying each of two plausible metaphysical principles: that a cause cannot cause anything occurring before its ground and that a cause cannot cause anything belonging to its ground. We therefore have to reject either consequentialism or the causal efficacy of moral properties or the plausible metaphysical principles. And, I’ll show, the puzzle arises again even if we replace moral properties with the (...) non-moral properties making things right. Which component to reject is a question for another occasion: my aim here is to present the puzzle. It is a puzzle worth thinking about: no matter how we solve it, we stand to learn something, be it in normative ethics, metaethics, or metaphysics. And, I’ll suggest at the end of the paper, my arguments can be applied to other domains as well. (shrink)

German universities come under fire: in contemporary political discourse they are considered to be antiquated, inefficient and unfit for international competition. Accordingly, the German government implemented an extensive program of reforms. Following the so‐called ‘Sorbonne Declaration’, the universities shall become part of an European higher education system with comparable and compatible structures. With the focus on the field of academic teaching and learning, this essay discusses the way of defining these activities in a new, entrepreneurial way, and the implications of (...) this process within the university. The reflections lead to the thesis that the actual reforms ask for new forms of critique, because the neoliberal offer of marketable ways to teach and to learn makes the enduring asymmetry of power relations within the educational field invisible, endangers the democratic character of the university and trivializes education. This study examines whether and how a CEO’s personal traits (gender, altruism, age, and founder) influence organizational performance. Building upon upper echelons theory, this study develops a conceptual framework that gives explicit recognition to how the institutional environment surrounding the CEOs shapes their characteristics, which, in turn, are reflected in the different organizational strategies and performance. This study moves beyond the existing focus on for-profit corporations and conducts the empirical analysis on a novel, hand-collected, longitudinal dataset of 1342 firm-year observations (...) of 128 faith-based charity organizations operating in a major developing, Muslim-majority country in the period 1996–2019. This study reveals that those faith-based charity organizations led by CEOs with specific personal traits (woman, altruistic, young, and founder) exhibit better organizational performance. Importantly, CEOs’ personal traits, however, do not have a uniform, systematic effect; their effect is generally strengthened when the CEO is also the founder of the faith-based charity organization, given the greater latitude of managerial discretion that a CEO has in managing the organization. Our findings have important implications for individual charity organizations; their board of directors; and their stakeholders, in particular the communities they serve, as well as the whole society where they operate. In this paper I sketch a systematic reconstruction of Husserl’s fundamental concept of “attitude”. I first explore Husserl’s account with respect to the three faculties of intellect, will, and emotivity [Gemüt], which also define the three basic kinds of attitude. The attitude assumed by the subject plays at this level the important role of articulating and unifying, according to an overall direction, various underlying moments of a complex act. I then focus on the specific intellectual, viz. cognitive attitudes and highlight (...) the difference between the naturalistic attitude (which characterizes the natural sciences) and the personalistic attitude (which characterizes the human sciences). I then consider the notion of the natural attitude and argue that the personalistic attitude represents the systematic core of it. The natural attitude may be defined as the human attitude, i.e., as the attitude in which subjects posit themselves exclusively as human subjects belonging to the world , which is itself unceasingly posited as being. In the final part of the paper I explore the function of the phenomenological reduction insofar as it opens up a possibility of self-understanding that breaks with the natural, human self-apprehension and discloses subjectivity in its transcendental dimension. This opens up a radically new attitude, the phenomenological, which should not be confused with a first-person perspective within the framework of the natural attitude. (shrink)
